A. Session Fee: Client agrees to pay photographer a non-refundable session fee of $_____ (Investment amount varies based on type of session)before the session starts. This fee covers the time and talent of photographer, basic retouching and creative editing of images, as determined by the photographer, and a digital gallery of images (up to 20 images and can depend on specific customized session).
B. Location Costs & Fees: If there are any costs/fees associated with the location the client has chosen for their session, you, the client, will be responsible for those fees. The photographer will not guarantee or arrange any payment on any location. Creative fee covers travel within 1 hour of the ALP Studio(s). Any location outside of these limits will be subject to an additional charge of $0.55/km as part of the agreement.
C. Circumstances: If an illness or situation prevents a photo session from taking place, client may reschedule at least 24 hours prior to their shoot without penalty. Should client fail to give 24 hours notice, or decide to completely cancel the shoot, this session fee is forfeited and will not be refunded. Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control.
D. Proofs: Proofing of client’s images will be available for viewing within 2-4 weeks of session date in a password-protected web-gallery.
E. Ordering: Due to the custom nature of each session, all sales are final and non-refundable. Client must be absolutely sure of their purchase prior to the end of your ordering session, as print orders are placed to our professional lab within one to two (1-2) business day(s) after your viewing appointment.
F. Archive: All images will be available for ordering for two (2) months following client viewing date. After two (2) months, all images will be purged from photographer’s hard-drive, except as needed for promotional purposes, to be determined by photographer at photographer’s sole discretion. Photographer is not responsible for loss or damage to the digital files due to circumstances beyond photographer’s control.
G. Payment: All payments are due in full unless payment arrangements have been made. Orders will not be processed until payment in full is received. If client has arranged a payment plan, order will be placed after the final payment has been received.
H. Damage: Photographer is not responsible for the damage of portraits after delivery to client, including damage caused during transit by Canada Post or any other mail carrier. Client assumes all responsibility for the safety of all portraits upon receipt. All portraits sent via Canada Post can be insured and require delivery confirmation upon client’s request and at client’s expense.
I. Model Release: Photographer kindly asks that all clients sign the model release so that photographer may display the images from their session on photographer’s website, www.adalillyphotography.com, company Facebook page, Instagram or any other social media platforms chosen, and for using for marketing/promotional/ advertising purposes.
J. Liability: Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business.
K. Copyright & Penalty: AdaLilly Photography retains all copyrights to all images created during client’s session. A print release may be purchased with digital files to print portraits for personal use up to designated size listed on print release. It is illegal to copy, scan, download, print, share, or alter any image created by Inspired Photograpy by Andrea during client’s photo session.
L. Indemnification: The Photographer shall be held harmless for any and all injury to client during the course of the photography session and the immediately surrounding events.
M. Waivers: The waiver of any breach of this Contract shall not constitute a continuing waiver or a waiver of any subsequent breach of the same or a different provision of this Contract.
N. Attorney’s Fees: If either party to this Contract brings a legal action against the other party to this Contract to secure the specific performance of this Contract, collect damages for breach of this Contract, or otherwise enforce or interpret this Contract, each party shall be responsible for their own reasonable attorney’s fees and all costs, premiums for bonds, fees, and other expenses expended or incurred in the action in addition to any other relief that may be awarded.
O. All & any sessions scheduled with AdaLilly Photography must have a signed agreement and full session payment before any portraits will be taken.
P. Cancellations: There shall be no refund of the retainer. Any and all payments toward the balance are non-refundable once paid. Any and all cancellations must be in writing by email.
Change of Date or Venue: AdaLilly Photography must be notified immediately of any changes in schedule or location at least one week prior to the event.
Deposit: A non-refundable deposit of $500 is required to hold the date of your event. The balance of all fees owed must be paid at least 30 days prior to the event. If final payment is not received, AdaLilly Photography will not be expected to attend said event.
Cancellation: There shall be no refund of the deposit. Any and all payments toward the balance are non-refundable once paid. Cancellations must be in writing, emailed to AdaLilly Photography.
Failure to Perform: Due to the limited and subjective nature of the event, AdaLilly Photography cannot be held responsible for requested photographs not taken or missed, lack of coverage resulting from weather conditions, or schedule complications caused by, but not limited to, anyone in or at the event, or by the church or location restrictions. The Photographer is not responsible for lost photo opportunities due to other cameras or flashes, the lateness of the bride or groom, or other principles. While AdaLilly Photography makes every effort to take requested photographs, it is acknowledged that any lists submitted to AdaLilly Photography will be used for organizational purposes; no particular photograph is guaranteed.
Force Majeure: If AdaLilly Photography or their assigns cannot perform this agreement due to a fire, casualty, strike or other civil disturbance, Act of God, including but not limited to road closures, severe traffic, terrorism, or other causes beyond the control of the parties involved, or due to the Photographer’s illness, then AdaLilly Photography shall have no further liability with respect to this agreement. This limitation of liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or memory card malfunction, or otherwise lost or damaged.
Copyright: Title (possession) of and copyright to all images shall remain with AdaLilly Photography. It is illegal to copy, scan, reproduce, or alter in any way any of the images provided by AdaLilly Photography or her subcontractors without written permission.
Exclusive Photographer: AdaLilly Photography shall be the exclusive photographer retained by the client for the purpose of photographing the wedding. Family and friends of the client and other wedding vendors shall not interfere with the Photographer’s duties. Guests should be asked by the client to refrain from using cameras and iphones during the ceremony.
Event Food Service: A light meal is required for the Photographer(s) for events up to 4 hours long. For events beyond 4 hours, a full-course meal is required.
Hotel Fee: A hotel fee of $200 is required if 1) your event is farther than 100 km from Calgary, and 2) services are required past 8:00pm.
Returned Cheques: Returned cheques are subject to a $50.00 returned cheque fee.
Creative License: Images are edited at the discretion of AdaLilly Photography. Delivered galleries may not include all images shot. The Photographer reserves the right to edit and release only those images deemed creditable as professional quality and within the Photographer’s artistic standards.
Substitution: In the event of illness or sudden event out of the control of AdaLilly Photography, an attempt to find a substitute photographer will be made at no cost to the client. The contract will then be transferred to the substitute photographer if available. Image
Storage: AdaLilly Photography recommends proper care with all print products purchased as well as backing up all images to an additional format, such as a hard drive or flash drive. AdaLilly Photography is not responsible for the storage of any images or print products after they are delivered.
Marketing: Permission is hereby granted to AdaLilly Photography to use any images created under this agreement for professional samples, displays, website pages, advertising, e-marketing campaigns, e-mails, social media, contests, and any other purpose.
Privacy Agreement: Only the bride and groom (or signers of the document) can discuss the terms of any contract with the Photographer. Should the client share any contract with anyone other than the above the client shall be solely responsible for the breach of the contract releasing photographer of any liability. Client agrees all fees paid against balance owing will not be refunded.
RETOUCHING: SHOULD ANY IMAGE REQUIRE ADDITIONAL RETOUCHING, THE FIRST 3 IMAGES ARE FREE, ANYTHING AFTER THAT IS CHARGED OUT AT MY HOURLY RATE OF $249/HR (NOTE: RETOUCHING WILL BE DONE AT THE DISCRETION OF THE PHOTOGRAPHER, NO REQUEST HAS GUARANTEED APPROVAL.)
RUSH IMAGERY: UNFORTUNATELY I DO NOT RUSH ANY IMAGES. I ALSO DONT BUMP THE LINE. I HAVE SEVERAL LOYAL CLIENTS THAT WAIT PATIENTLY FOR THEIR IMAGES AND I REMAIN TO FAIR WHEN EDITING IN ORDER OF SESSION AND TIME. TIME FRAMES CAN VARY DEPENDING ON THE TIME OF YEAR.
ADMIN FEES: ALL PHOTOGRAPHY FEES INCLUDE A $50 ADMINISTRATION FEE.
